Law Research Paper Topics Ideas to Choose From

Law students are also obligated to write research papers. This academic writing paper must include original findings, and the author should do all the interpretation, analysis, and research.

Such assignments are usually doctoral dissertations, master’s thesis, or term papers. It’s important not to confuse research proposals with law research paper topics. Research proposals are written for proposing research projects while looking for sponsorship for the whole project.

However, before you can start writing your research paper, it’s important to go through all the relevant options and pick the right one. This post will help you with that.

How to Choose Good Law Research Topics

Law Research Paper Topics

It’s absolutely essential to figure out your topic early on. It should shape all the work and effort you will have to put into writing the paper. Choosing legal topics for research papers isn’t always as easy as it sounds.

That is why some universities want to make it easier for their students to select criminal justice research topics for them. However, the majority of specialized educational institutions require students to do this themselves. The first thing that should be your main consideration is topics that you actually care about.

In other words, find a topic that you find interesting. No matter how hard the paper becomes, finishing the project will always be easier if you’re genuinely passionate about it.

Tips on Choosing a Topic

Essential Research Tools: Navigating Legal Databases, Libraries, and Online Resources for Law Students

Diving into your research paper necessitates equipping yourself with the right resources. A well-researched paper, after all, is built on the backbone of credible information. To that end, here are some key databases, law libraries, and online resources to assist in your academic voyage:

Westlaw : As one of the most extensive legal research databases available, Westlaw provides a treasure chest of case law, legislation, and academic sources for both US and UK jurisdictions.

LexisNexis : Another invaluable resource, LexisNexis offers a robust collection of legal resources including case law, statutes, secondary sources, and a vast news archive.

HeinOnline : With a concentration on law journals, HeinOnline is perfect for scholarly articles, legal classics, and historical legal statutes.

JSTOR : Although not exclusively law-focused, JSTOR contains a vast collection of academic articles, many of which cover legal topics and provide invaluable insights.

Google Scholar : A free resource, Google Scholar can be used to find both legal opinions and journals. Its cited by feature can also assist you in discovering related research.

Local Law Libraries : Don't forget about your local law library. These libraries often provide access to databases that may otherwise require a subscription.

Government Websites : Both US and UK government websites publish numerous reports and statistics that could provide useful data for your paper.

Remember, each resource comes with its own strengths, so make sure to use a combination to get a well-rounded perspective on your topic. Be persistent, be critical, and remember to cross-check information across different sources. Happy researching!

Strategies and Tips for Writing an Impactful Law Research Paper

Embarking on your law research paper journey can be a challenging task. From formulating your research plan to presenting a convincing argument, each step is crucial. Here are some helpful tips to guide you in crafting an impactful research paper:

Develop a Comprehensive Research Plan : Before you dive into writing, lay out a comprehensive plan. Identify your key questions, the resources you'll need, and a timeline. This not only provides a roadmap for your research but also helps keep you focused and on track.

Understanding and Analyzing Legal Issues : Law isn't about memorizing statutes; it's about understanding and interpreting them. When you tackle a legal issue, aim to comprehend its complexities, evaluate different viewpoints, and provide a balanced analysis.

Create a Strong Thesis Statement : Your thesis statement is the compass that guides your paper. It should be clear, concise, and debatable. It should present your main argument and give the reader a glimpse of your conclusion.

Maintain Logical Flow : A well-written research paper maintains a logical flow. Each paragraph should be linked to the next, each argument should build upon the previous, and every piece of evidence should support your thesis.

Cite Your Sources Properly : Citing your sources is essential in a law research paper. It not only gives credit where it's due but also allows your reader to trace your research path. Make sure to familiarize yourself with the citation style your institution prefers (e.g., Bluebook, Oxford, etc.).

Avoid Plagiarism : Plagiarism is a grave academic offense. Always ensure that your work is original, and whenever you use someone else's work or ideas, make sure to cite it properly.

Proofread and Edit Your Paper : Never underestimate the power of a well-edited paper. After writing, take the time to read your paper aloud, check for grammatical errors, and ensure that your arguments are clear and logical. If possible, have a classmate or a mentor review your paper. They can provide valuable feedback and catch errors you might have missed.

Remember, writing a research paper is not just an academic exercise; it's a craft. It's about distilling complex information into understandable insights. It's about persuasion and storytelling. And, it's about demonstrating your understanding and passion for the law. So, put on your lawyer's hat and get writing!

Legal Research Strategy

Preliminary analysis, organization, secondary sources, primary sources, updating research, identifying an end point, getting help, about this guide.

This guide will walk a beginning researcher though the legal research process step-by-step. These materials are created with the 1L Legal Research & Writing course in mind. However, these resources will also assist upper-level students engaged in any legal research project.

How to Strategize

Legal research must be comprehensive and precise.  One contrary source that you miss may invalidate other sources you plan to rely on.  Sticking to a strategy will save you time, ensure completeness, and improve your work product.

Follow These Steps

Running Time: 3 minutes, 13 seconds.

Make sure that you don't miss any steps by using our:

  • Legal Research Strategy Checklist

If you get stuck at any time during the process, check this out:

  • Ten Tips for Moving Beyond the Brick Wall in the Legal Research Process, by Marsha L. Baum

Understanding the Legal Questions

A legal question often originates as a problem or story about a series of events. In law school, these stories are called fact patterns. In practice, facts may arise from a manager or an interview with a potential client. Start by doing the following:

Read > Analyze > Assess > Note > Generate

  • Read anything you have been given
  • Analyze the facts and frame the legal issues
  • Assess what you know and need to learn
  • Note the jurisdiction and any primary law you have been given
  • Generate potential search terms

Jurisdiction

Legal rules will vary depending on where geographically your legal question will be answered. You must determine the jurisdiction in which your claim will be heard. These resources can help you learn more about jurisdiction and how it is determined:

  • Legal Treatises on Jurisdiction
  • LII Wex Entry on Jurisdiction

This map indicates which states are in each federal appellate circuit:

A Map of the United States with Each Appellate Court Jurisdiction

Getting Started

Once you have begun your research, you will need to keep track of your work. Logging your research will help you to avoid missing sources and explain your research strategy. You will likely be asked to explain your research process when in practice. Researchers can keep paper logs, folders on Westlaw or Lexis, or online citation management platforms.

Organizational Methods

Tracking with paper or excel.

Many researchers create their own tracking charts.  Be sure to include:

  • Search Date
  • Topics/Keywords/Search Strategy
  • Citation to Relevant Source Found
  • Save Locations
  • Follow Up Needed

Consider using the following research log as a starting place:

  • Sample Research Log

Tracking with Folders

Westlaw and Lexis offer options to create folders, then save and organize your materials there.

  • Lexis Advance Folders
  • Westlaw Edge Folders

Tracking with Citation Management Software

For long term projects, platforms such as Zotero, EndNote, Mendeley, or Refworks might be useful. These are good tools to keep your research well organized. Note, however, that none of these platforms substitute for doing your own proper Bluebook citations. Learn more about citation management software on our other research guides:

Types of Sources

There are three different types of sources: Primary, Secondary, and Tertiary.  When doing legal research you will be using mostly primary and secondary sources.  We will explore these different types of sources in the sections below.

Graph Showing Types of Legal Research Resources. Tertiary Sources: Hollis, Law Library Website. Secondary Sources: Headnotes & Annotations, American Law Reports, Treatises, Law Reviews & Journals, Dictionaries and Encyclopedias, Restatements. Primary Sources: Constitutions, Treatises, Statutes, Regulations, Case Decisions, Ordinances, Jury Instructions.

Secondary sources often explain legal principles more thoroughly than a single case or statute. Starting with them can help you save time.

Secondary sources are particularly useful for:

  • Learning the basics of a particular area of law
  • Understanding key terms of art in an area
  • Identifying essential cases and statutes

Consider the following when deciding which type of secondary source is right for you:

  • Scope/Breadth
  • Depth of Treatment
  • Currentness/Reliability

Chart Illustrating Depth and Breadth of Secondary Sources by Type. Legal Dictionaries (Shallow and Broad), Legal Encyclopedias (Shallow and Broad), Restatements (Moderately Deep and Broad), Treatises (Moderately Deep and Moderately Narrow), American Law Reports (Extremely Deep and Extremely Narrow), Law Journal Articles (Extremely Deep and Extremely Narrow)

Legal Encyclopedias

Legal encyclopedias contain brief, broad summaries of legal topics, providing introductions and explaining terms of art. They also provide citations to primary law and relevant major law review articles.

Graph illustrating that Legal Encyclopedias have broad coverage of subject matter and content with shallow treatment of the topics.

Here are the two major national encyclopedias:

  • American Jurisprudence (AmJur) This resource is also available in Westlaw & Lexis .
  • Corpus Juris Secundum (CJS)

Treatises are books on legal topics.  These books are a good place to begin your research.  They provide explanation, analysis, and citations to the most relevant primary sources. Treatises range from single subject overviews to deep treatments of broad subject areas.

Graph illustrating that Treatises are moderate in scope and relatively deep.

It is important to check the date when the treatise was published. Many are either not updated, or are updated through the release of newer editions.

To find a relevant treatise explore:

  • Legal Treatises by Subject by Catherine Biondo Last Updated Sep 12, 2023 1328 views this year

American Law Reports (ALR)

American Law Reports (ALR) contains in-depth articles on narrow topics of the law. ALR articles, are often called annotations. They provide background, analysis, and citations to relevant cases, statutes, articles, and other annotations. ALR annotations are invaluable tools to quickly find primary law on narrow legal questions.

Graph illustrating that American Law Reports are narrow in scope but treat concepts deeply.

This resource is available in both Westlaw and Lexis:

  • American Law Reports on Westlaw (includes index)
  • American Law Reports on Lexis

Law Reviews & Journals

Law reviews are scholarly publications, usually edited by law students in conjunction with faculty members. They contain both lengthy articles and shorter essays by professors and lawyers. They also contain comments, notes, or developments in the law written by law students. Articles often focus on new or emerging areas of law and may offer critical commentary. Some law reviews are dedicated to a particular topic while others are general. Occasionally, law reviews will include issues devoted to proceedings of panels and symposia.

Graph illustrating that Law Review and Journal articles are extremely narrow in scope but exceptionally deep.

Law review and journal articles are extremely narrow and deep with extensive references.

To find law review articles visit:

  • Law Journal Library on HeinOnline
  • Law Reviews & Journals on LexisNexis

Restatements

Restatements are highly regarded distillations of common law, prepared by the American Law Institute (ALI). ALI is a prestigious organization comprised of judges, professors, and lawyers. They distill the "black letter law" from cases to indicate trends in common law. Resulting in a “restatement” of existing common law into a series of principles or rules. Occasionally, they make recommendations on what a rule of law should be.

Restatements are not primary law. However, they are considered persuasive authority by many courts.

Graph illustrating that Restatements are broad in scope and treat topics with moderate depth.

Restatements are organized into chapters, titles, and sections.  Sections contain the following:

  • a concisely stated rule of law,
  • comments to clarify the rule,
  • hypothetical examples,
  • explanation of purpose, and
  • exceptions to the rule

Primary Authority

Primary authority is "authority that issues directly from a law-making body."   Authority , Black's Law Dictionary (11th ed. 2019).   Sources of primary authority include:

  • Constitutions
  • Statutes

Regulations

Access to primary legal sources is available through:

  • Bloomberg Law
  • Free & Low Cost Alternatives

Statutes (also called legislation) are "laws enacted by legislative bodies", such as Congress and state legislatures.  Statute , Black's Law Dictionary (11th ed. 2019).

We typically start primary law research here. If there is a controlling statute, cases you look for later will interpret that law. There are two types of statutes, annotated and unannotated.

Annotated codes are a great place to start your research. They combine statutory language with citations to cases, regulations, secondary sources, and other relevant statutes. This can quickly connect you to the most relevant cases related to a particular law. Unannotated Codes provide only the text of the statute without editorial additions. Unannotated codes, however, are more often considered official and used for citation purposes.

Case Basics

In many areas, finding relevant caselaw will comprise a significant part of your research. This Is particularly true in legal areas that rely heavily on common law principles.

Running Time: 3 minutes, 10 seconds.

Unpublished Cases

Up to  86% of federal case opinions are unpublished. You must determine whether your jurisdiction will consider these unpublished cases as persuasive authority. The Federal Rules of Appellate Procedure have an overarching rule, Rule 32.1  Each circuit also has local rules regarding citations to unpublished opinions. You must understand both the Federal Rule and the rule in your jurisdiction.

  • Federal and Local Rules of Appellate Procedure 32.1 (Dec. 2021).
  • Type of Opinion or Order Filed in Cases Terminated on the Merits, by Circuit (Sept. 2021).

Each state also has its own local rules which can often be accessed through:

  • State Bar Associations
  • State Courts Websites

Finding Cases

Image of a Headnote in a Print Reporter

Headnotes show the key legal points in a case. Legal databases use these headnotes to guide researchers to other cases on the same topic. They also use them to organize concepts explored in cases by subject. Publishers, like Westlaw and Lexis, create headnotes, so they are not consistent across databases.

Headnotes are organized by subject into an outline that allows you to search by subject. This outline is known as a "digest of cases." By browsing or searching the digest you can retrieve all headnotes covering a particular topic. This can help you identify particularly important cases on the relevant subject.

Running Time: 4 minutes, 43 seconds.

Each major legal database has its own digest:

  • Topic Navigator (Lexis)
  • Key Digest System (Westlaw)

Start by identifying a relevant topic in a digest.  Then you can limit those results to your jurisdiction for more relevant results.  Sometimes, you can keyword search within only the results on your topic in your jurisdiction.  This is a particularly powerful research method.

One Good Case Method

After following the steps above, you will have identified some relevant cases on your topic. You can use good cases you find to locate other cases addressing the same topic. These other cases often apply similar rules to a range of diverse fact patterns.

  • in Lexis click "More Like This Headnote"
  • in Westlaw click "Cases that Cite This Headnote"

to focus on the terms of art or key words in a particular headnote. You can use this feature to find more cases with similar language and concepts.

Ways to Use Citators

A citator is "a catalogued list of cases, statutes, and other legal sources showing the subsequent history and current precedential value of those sources.  Citators allow researchers to verify the authority of a precedent and to find additional sources relating to a given subject." Citator , Black's Law Dictionary (11th ed. 2019).

Each major legal database has its own citator.  The two most popular are Keycite on Westlaw and Shepard's on Lexis.

  • Keycite Information Page
  • Shepard's Information Page

Making Sure Your Case is Still Good Law

Using Citators For

Citators serve three purposes: (1) case validation, (2) better understanding, and (3) additional research.

Case Validation

Is my case or statute good law?

  • Parallel citations
  • Prior and subsequent history
  • Negative treatment suggesting you should no longer cite to holding.

Better Understanding

The Law Student’s Guide to Choosing a Research Paper Topic That’s Relevant, Interesting, and Manageable

Legal Writing

A research paper is a scholarly work that delves deep into a specific topic, presenting a comprehensive analysis, critical evaluation and new insights. These papers serve as a platform for students to showcase their analytical prowess, legal acumen and ability to contribute meaningfully to the field.

This article aims to shed light on the significance of research papers for law students and to provide a roadmap for choosing a research paper topic that resonates with both the student’s interests and the broader legal landscape.

The Importance of Research Papers for Law Students

Why is writing a research paper a fundamental rite of passage for law students? The answer lies in the multifaceted benefits that this endeavour offers. Firstly, research papers provide an opportunity for students to engage in rigorous intellectual inquiry. Through extensive research, students not only expand their knowledge base but also hone their critical thinking skills as they navigate complex legal concepts, arguments and counterarguments.

Secondly, research papers offer a unique chance to contribute to the evolving legal discourse. By tackling topics that have not been exhaustively explored or by offering fresh perspectives on established issues, students can play a role in shaping legal thought and influencing future decisions and policies.

Moreover, research papers nurture the invaluable skill of effective communication. The process of articulating intricate legal ideas into coherent prose fosters the development of clear, concise and persuasive writing skills—a skill set vital for a successful legal career.

Factors to Consider When Choosing a Research Paper Topic

Selecting the right research paper topic is a decision that demands careful consideration. Here are some pivotal factors to keep in mind:

Personal Interest

Choosing a topic that genuinely piques your interest is paramount. Passion fuels productivity and engagement throughout the research process. When a topic resonates personally, the exploration and analysis become more enriching, leading to a more impactful end result.

Relevance to the Legal Field

Opt for a topic that aligns with the broader legal landscape. Consider societal, ethical or jurisprudential implications. A topic that holds significance for the legal profession and society at large amplifies the paper’s relevance and contribution.

Depth of Research

Assess the potential for in-depth research. A well-researched paper often requires a solid foundation of resources, ranging from case law and statutes to academic literature. Ensure that there is ample material available to support your exploration.

The gap in Existing Literature

Identify gaps, controversies or unexplored dimensions within existing legal literature. Research papers that shed light on uncharted territory or provide innovative solutions tend to stand out and contribute more significantly to the field.

Feasibility

While ambition is commendable, it’s crucial to select a topic that is feasible within the given time frame and resources. A topic that is too broad might lead to a superficial analysis, while one that is too narrow might limit the scope of your research.

Balance of Challenge and Confidence

Striking a balance between a topic that challenges you and one that aligns with your expertise is crucial. A challenging topic fuels growth, but it’s equally important to have the foundational knowledge to navigate it effectively.

Future Relevance

Consider how the topic might resonate with your future career aspirations. If you envision a career in a specific legal area, selecting a topic related to that field could serve as a foundation for future specialisation.

Selecting the right research paper topic is a pivotal step that lays the foundation for a successful and impactful research endeavour. With numerous areas of law to explore, it’s essential to consider several factors that will guide you toward a topic that aligns with your interests, goals and the needs of the legal landscape.

The cornerstone of an engaging research paper is personal interest. Opting for a topic that genuinely captivates your curiosity not only enhances your motivation but also infuses enthusiasm into your research and writing process. A topic that resonates with you ensures that the hours spent delving into legal intricacies are both enjoyable and rewarding.

Research Gap

An effective research paper addresses a gap in the existing legal literature. Identifying areas where previous research falls short or where there is a lack of comprehensive analysis is a strategic approach. This might entail selecting a topic that hasn’t received thorough exploration or choosing a subject where experts hold divergent opinions. Addressing these gaps adds depth and significance to your research.

The scope of your chosen topic is crucial to the success of your research paper. Striking the right balance between a topic that is narrow enough to allow for focused analysis and one that is broad enough to provide room for in-depth research is essential. A topic that is overly broad might result in superficial coverage, while an excessively narrow topic might limit your ability to explore its complexities.

Relevance is a guiding principle in selecting a research paper topic. Consider the impact of your chosen topic on the broader legal landscape, society or even your own career aspirations. A topic that is intrinsically linked to current legal debates, societal concerns or your intended career trajectory not only elevates the importance of your research but also contributes to meaningful legal discourse.

Legal Developments

The dynamic nature of law demands a keen awareness of recent legal developments. Consider recent judgments, legislative changes and emerging legal trends that could impact your chosen topic. Integrating these contemporary elements not only lends currency to your research but also showcases your ability to engage with the evolving legal environment.

How to Find a Research Paper Topic

The process of finding a compelling research paper topic requires a combination of curiosity, exploration and engagement. Here are some effective strategies to help you discover a topic that ignites your intellectual passion and aligns with the demands of the legal field:

Consult Professors and Peers

Your professors and classmates are valuable resources in your quest for a research paper topic. Professors often possess insights into underexplored areas of law or emerging trends that could inspire your research. Engage in discussions with your peers, as they might offer fresh perspectives and even share their own areas of interest.

Conduct Preliminary Research

Start on a journey of preliminary research by delving into various legal topics. This exploratory phase helps you identify areas that resonate with your interests and offer substantial research potential. As you delve deeper into these topics, you’ll gain a clearer sense of their scope and relevance to the legal landscape.

Read Law Journals and Magazines

Law journals and magazines are treasure troves of legal discourse, often featuring articles that delve into cutting-edge legal issues. Reading these publications exposes you to the forefront of legal thought and can spark ideas for research topics that address contemporary legal challenges, recent case law or evolving jurisprudence.

Attend Legal Conferences and Workshops

Participating in legal conferences and workshops provides an immersive environment for learning about new legal topics and trends. These events offer the opportunity to engage with experts, academics, practitioners and fellow students. Listening to presentations, participating in discussions and networking can help you identify areas that intrigue you and are worthy of further exploration.

Tips for writing a research paper.

Writing a research paper is a journey that requires meticulous planning, thoughtful execution and a keen eye for detail. Here are essential tips to guide you through the process, ensuring that your research paper is not only well-written but also impactful and credible:

Start Early

Procrastination can be the downfall of even the most well-intentioned projects. Begin your research and writing process as early as possible. This grants you ample time to delve into your chosen topic, conduct thorough research, refine your arguments and polish your final draft. Starting early also allows for unexpected challenges and revisions without feeling rushed.

Be Organised

Organisational skills are your allies in the research paper journey. Maintain a detailed record of your sources, including books, articles, websites and case law. Proper citations are crucial for avoiding plagiarism and lending credibility to your work. Create a system for organising notes, excerpts and thoughts to streamline the writing process.

Write a Strong Introduction

An introduction is the gateway to your research paper. Craft an introduction that captivates the reader’s attention and sets the tone for your analysis. Clearly state the purpose of your research, introduce your central thesis and provide a roadmap of the main points you’ll be discussing. A strong introduction entices the reader to explore further.

Use Evidence to Support Arguments

Substantiate your arguments with solid evidence. This entails citing legal precedents, case law, statutes, academic literature and other credible sources. The inclusion of evidence not only strengthens your claims but also showcases your engagement with the subject matter. Balance your own analysis with authoritative sources to present a comprehensive perspective.

Write a Clear and Concise Conclusion

The conclusion is your opportunity to tie all the threads of your research together. Summarise the main points of your paper, restate your thesis statement and reflect on the implications of your findings. Avoid introducing new information in the conclusion; instead, offer insights that leave a lasting impression on the reader.

Revise and Edit

Revision and editing are non-negotiable steps in the writing process. After completing your initial draft, take a step back before revisiting it. Pay attention to clarity, coherence, grammar and syntax. Proofread meticulously to eliminate errors. Consider seeking feedback from peers, professors or writing centres to gain a fresh perspective.

Maintain Consistent Formatting

Adhere to the specific formatting guidelines required by your institution or professor. Consistency in formatting, citations and referencing not only showcases your attention to detail but also enhances the professionalism of your work.

Work on Feedback

Welcome constructive feedback from peers, mentors and professors. Different perspectives can illuminate areas for improvement and enhance the quality of your research paper. Constructive criticism helps refine your arguments and ensures that your work meets the highest standards.

Final Thoughts

The journey of choosing and crafting a research paper topic is a pivotal chapter in a law student’s academic voyage. By aligning personal interests with the demands of the legal landscape, students can delve into topics that resonate, challenge and contribute. Equipped with well-organised research, compelling introductions, evidence-backed arguments and concise conclusions, the research paper becomes a powerful vessel of knowledge and insight.

As law students adopt the art of meticulous writing and engage in scholarly dialogue, they not only enrich their own learning but also shape the ongoing discourse that drives the evolution of law.

EU AI Act: first regulation on artificial intelligence

The use of artificial intelligence in the EU will be regulated by the AI Act, the world’s first comprehensive AI law. Find out how it will protect you.

A man faces a computer generated figure with programming language in the background

As part of its digital strategy , the EU wants to regulate artificial intelligence (AI) to ensure better conditions for the development and use of this innovative technology. AI can create many benefits , such as better healthcare; safer and cleaner transport; more efficient manufacturing; and cheaper and more sustainable energy.

In April 2021, the European Commission proposed the first EU regulatory framework for AI. It says that AI systems that can be used in different applications are analysed and classified according to the risk they pose to users. The different risk levels will mean more or less regulation. Once approved, these will be the world’s first rules on AI.

Learn more about what artificial intelligence is and how it is used

What Parliament wants in AI legislation

Parliament’s priority is to make sure that AI systems used in the EU are safe, transparent, traceable, non-discriminatory and environmentally friendly. AI systems should be overseen by people, rather than by automation, to prevent harmful outcomes.

Parliament also wants to establish a technology-neutral, uniform definition for AI that could be applied to future AI systems.

Learn more about Parliament’s work on AI and its vision for AI’s future

AI Act: different rules for different risk levels

The new rules establish obligations for providers and users depending on the level of risk from artificial intelligence. While many AI systems pose minimal risk, they need to be assessed.

Unacceptable risk

Unacceptable risk AI systems are systems considered a threat to people and will be banned. They include:

  • Cognitive behavioural manipulation of people or specific vulnerable groups: for example voice-activated toys that encourage dangerous behaviour in children
  • Social scoring: classifying people based on behaviour, socio-economic status or personal characteristics
  • Biometric identification and categorisation of people
  • Real-time and remote biometric identification systems, such as facial recognition

Some exceptions may be allowed for law enforcement purposes. “Real-time” remote biometric identification systems will be allowed in a limited number of serious cases, while “post” remote biometric identification systems, where identification occurs after a significant delay, will be allowed to prosecute serious crimes and only after court approval.

AI systems that negatively affect safety or fundamental rights will be considered high risk and will be divided into two categories:

1) AI systems that are used in products falling under the EU’s product safety legislation . This includes toys, aviation, cars, medical devices and lifts.

2) AI systems falling into specific areas that will have to be registered in an EU database:

  • Management and operation of critical infrastructure
  • Education and vocational training
  • Employment, worker management and access to self-employment
  • Access to and enjoyment of essential private services and public services and benefits
  • Law enforcement
  • Migration, asylum and border control management
  • Assistance in legal interpretation and application of the law.

All high-risk AI systems will be assessed before being put on the market and also throughout their lifecycle.

General purpose and generative AI

Generative AI, like ChatGPT, would have to comply with transparency requirements:

  • Disclosing that the content was generated by AI
  • Designing the model to prevent it from generating illegal content
  • Publishing summaries of copyrighted data used for training

High-impact general-purpose AI models that might pose systemic risk, such as the more advanced AI model GPT-4, would have to undergo thorough evaluations and any serious incidents would have to be reported to the European Commission.

Limited risk

Limited risk AI systems should comply with minimal transparency requirements that would allow users to make informed decisions. After interacting with the applications, the user can then decide whether they want to continue using it. Users should be made aware when they are interacting with AI. This includes AI systems that generate or manipulate image, audio or video content, for example deepfakes.

On December 9 2023, Parliament reached a provisional agreement with the Council on the AI act . The agreed text will now have to be formally adopted by both Parliament and Council to become EU law. Before all MEPs have their say on the agreement, Parliament’s internal market and civil liberties committees will vote on it.

This will help you assess the availability of research material and identify any gaps or areas for further exploration.
  • Review Case Law and Legal Precedents : In intellectual property law, case law plays a crucial role in shaping legal principles and interpretations. Analyzing landmark court decisions and legal precedents in your chosen area can provide valuable insights and serve as a foundation for your research paper.
  • Consult with Professors and Experts : Seek guidance from your professors or intellectual property law experts regarding potential intellectual property law research paper topics. They can offer valuable insights, suggest relevant readings, and provide feedback on the feasibility and relevance of your chosen topic.
  • Consider Practical Applications : Intellectual property law has real-world implications and applications. Consider choosing a research topic that has practical significance and addresses real challenges faced by individuals, businesses, or society at large. For example, you might explore the role of intellectual property in facilitating technology transfer in developing countries or the impact of intellectual property rights on access to medicines.
  • Analyze International Perspectives : Intellectual property law is not confined to national boundaries; it has significant international dimensions. Analyzing the differences and similarities in intellectual property regimes across different countries can offer a comparative perspective and enrich your research paper.
  • Propose Solutions to Existing Problems : A compelling research paper in intellectual property law can propose innovative solutions to existing problems or challenges in the field. Consider focusing on an area where there are unresolved debates or conflicting interests and offer well-reasoned solutions based on legal analysis and policy considerations.
  • Seek Feedback and Refine Your Topic : Once you have narrowed down your research paper topic, seek feedback from peers, professors, or mentors. Be open to refining your topic based on constructive criticism and suggestions. A well-defined and thoughtfully chosen research topic will set the stage for a successful and impactful research paper.

Choosing the right intellectual property law research paper topic requires careful consideration, passion, and a keen awareness of current developments in the field. By identifying your interests, staying updated on legal developments, narrowing down the scope, conducting preliminary research, and seeking guidance from experts, you can select a compelling and relevant topic that contributes to the academic discourse in intellectual property law. A well-chosen research topic will not only showcase your expertise and analytical skills but also provide valuable insights into the complexities and challenges of intellectual property law in the modern world.

How to Write an Intellectual Property Law Research Paper

Writing an intellectual property law research paper can be an intellectually stimulating and rewarding experience. However, it can also be a daunting task, especially for students who are new to the intricacies of legal research and academic writing. In this section, we will provide a comprehensive guide on how to write an effective and impactful intellectual property law research paper. From understanding the structure and components of the paper to conducting thorough research and crafting compelling arguments, these ten tips will help you navigate the writing process with confidence and proficiency.

  • Understand the Paper Requirements : Before diving into the writing process, carefully review the requirements and guidelines provided by your professor or institution. Pay attention to the paper’s length, formatting style (APA, MLA, Chicago/Turabian, Harvard, etc.), citation guidelines, and any specific instructions regarding the research paper topic or research methods.
  • Conduct In-Depth Research : A strong intellectual property law research paper is built on a foundation of comprehensive and credible research. Utilize academic databases, legal journals, books, and reputable online sources to gather relevant literature and legal precedents related to your chosen topic. Ensure that your research covers a wide range of perspectives and presents a well-rounded analysis of the subject matter.
  • Develop a Clear Thesis Statement : The thesis statement is the central argument of your research paper. It should be concise, specific, and clearly convey the main point you will be arguing throughout the paper. Your thesis statement should reflect the significance of your research topic and its contribution to the field of intellectual property law.
  • Create an Outline : An outline is a roadmap for your research paper, helping you organize your thoughts and ideas in a logical and coherent manner. Divide your paper into sections, each representing a key aspect of your argument. Within each section, outline the main points you will address and the evidence or analysis that supports your claims.
  • Introduction : Engage and Provide Context: The introduction of your research paper should captivate the reader’s attention and provide essential context for your study. Start with a compelling opening sentence or anecdote that highlights the importance of the topic. Clearly state your thesis statement and provide an overview of the main points you will explore in the paper.
  • Literature Review : In the early sections of your research paper, include a literature review that summarizes the existing research and scholarship on your topic. Analyze the key theories, legal doctrines, and debates surrounding the subject matter. Use this section to demonstrate your understanding of the existing literature and to identify gaps or areas where your research will contribute.
  • Legal Analysis and Argumentation : The heart of your intellectual property law research paper lies in your legal analysis and argumentation. Each section of the paper should present a well-structured and coherent argument supported by legal reasoning, case law, and relevant statutes. Clearly explain the legal principles and doctrines you are applying and provide evidence to support your conclusions.
  • Consider Policy Implications : Intellectual property law often involves complex policy considerations. As you present your legal arguments, consider the broader policy implications of your research findings. Discuss how your proposed solutions or interpretations align with societal interests and contribute to the advancement of intellectual property law.
  • Anticipate Counterarguments : To strengthen your research paper, anticipate potential counterarguments to your thesis and address them thoughtfully. Acknowledging and refuting counterarguments demonstrate the depth of your analysis and the validity of your position.
  • Conclusion : Recapitulate and Reflect: In the conclusion of your research paper, recapitulate your main arguments and restate your thesis statement. Reflect on the insights gained from your research and highlight the significance of your findings. Avoid introducing new information in the conclusion and instead, offer recommendations for further research or policy implications.

Writing an intellectual property law research paper requires meticulous research, careful analysis, and persuasive argumentation. By following the tips provided in this section, you can confidently navigate the writing process and create an impactful research paper that contributes to the field of intellectual property law. Remember to adhere to academic integrity and proper citation practices throughout your research, and seek feedback from peers or professors to enhance the quality and rigor of your work. A well-crafted research paper will not only demonstrate your expertise in the field but also provide valuable insights into the complexities and nuances of intellectual property law.
