JOHANNESBURG - The executive producer of Special Assignment told a disciplinary sitting that her department fulfilled its duties adequately despite an episode interdicted by the courts being flighted.
Busisiwe Ntuli took to the stand on Monday during her boss SABC Editor-in-Chief Phathiswa Magopeni's disciplinary hearing.
Magopeni is accused of failing to discharge her duties by preventing the episode from airing.

Court order
On Monday, Head of Output News Mlunghisi Shivamba who was Editor of Free-to-Air TV News and Current Affairs at the time the episode aired testified that the news department ensured it obliged the court order by finding a replacement episode.
He said the onus to ensure the airing of the correct episode lied with final control under the technical division and not with News.
“And also to see that we have put on the FCC sheet corresponds with what is in the tape. So, for them to simply look into an FCC sheet and conclude it corresponds and press a button, it’s very reckless of them. Because they need to account as a platform that this FCC sheet is what has been fed or loaded in their system. They do not have a right to just take an FCC sheet and think it suffices to put something on air,” said Shivamba.

“Miss Ntuli was saying that no instruction was received from legal for the episode to be deleted. I do not think that is criticism [against Vanara],” said Magopeni.
Bill pressed her: “You think it is a compliment?”
Magopeni retorted: “I think it is a comment; I do not think it is criticism.”
Their verbal boxing match continued until Magopeni admitted she agreed with Ntuli that it was Vanara who ought to have issued the instruction for the report to be removed.
Bill fired first: “Do you hold a view that an instruction was required?”
“I do,” said Magopeni, to which Bill interrupted: “You hold the view that this instruction was required from advocate Vanara?”
“It would not have come from anywhere else,” she responded.
Cassim said the blame game would not help him in any way because the question of who was to blame was “not before me”.
Speaking highly of Vanara’s involvement in the saga, Cassim said it was unfair to blame him in absentia when he had not been charged.
According to Cassim, Vanara’s involvement in the issue after the episode was aired was “commendable”, if anything.
However, the case before him was simple and straightforward: could Magopeni have done anything to prevent contempt of court?
